General Terms and Conditions
In the interest of readability, Costa Mandorla AG is designated 'Costa Mandorla' in the following, and the ordering party is designated ‘the customer’.
The food production of our suppliers in Italy is limited and represents seasonal annual products. As a consequence, the full selection is not available at all times.
Prices and payment for orders from Switzerland
Costa Mandorla ships orders to the customer upon receiving the customer’s pre-payment (when ordering the customer receives an invoice by Costa Mandorla which the customer is asked to pay for Costa Mandorla to initiate the shipping).
Our prices for the food items shown are subject to annual fluctuations. The prices shown include VAT. The cost of delivery within Switzerland by Swiss Post is charged separately to the customer for orders with a value below CHF 100. For orders with a value above CHF 100 the delivery to the customer by Swiss Post is free of charge (delivery by PostPac Economy).
For orders with a value below CHF 100 the following charges of Swiss Post apply (November 2020; the General Terms and Conditions of Swiss Post apply):
PostPac Economy (delivery in two working days after receipt of the pre-payment by Costa Mandorla):
Parcel, weight up to 2 Kg: CHF 7.00
Parcel, weight up to 10 Kg: CHF 9.70
PostPac Priority (delivery on the next working day after receipt of the pre-payment by Costa Mandorla):
Parcel, weight up to 2 Kg: CHF 9.00
Parcel, weight up to 10 Kg: CHF 10.70
Prices for orders from outside of Switzerland
Please email us (firstname.lastname@example.org) your order and we will let you know how much your order and shipping will cost.
Costa Mandorla offers the following discounts to its customers:
Orders above a value of CHF 500: 5% discount
Orders above a value of CHF 1’000: 10% discount
Correct delivery address
It is in customer’s interest to make sure the specified delivery address and telephone numbers are correct and complete. Costa Mandorla cannot assume any responsibility for delayed or failed deliveries due to incorrect or incomplete addresses.
Confirmation of orders and deliveries
Shortly after placing an online order, customers will be sent an order confirmation e-mail containing the order reference number, information on the product purchased, price, the addresses of the customer and the recipient of the good purchased. Then, once payment for the good purchased has been received, Costa Mandorla will notify the customer by e-mail as to when the delivery of the order can be expected. Customers who receive neither an order nor a payment confirmation are kindly requested to contact us by email (email@example.com).
Customer obligation to inspect products
Customers are obliged to immediately inspect the delivered products for correctness, completeness and potential transport damage. The customer shall inform Costa Mandorla by email (firstname.lastname@example.org) of any defects, or false or incomplete deliveries, immediately after detection thereof and within five calendar days after receipt of the delivery at the latest. The customer must retain the product in the condition it was delivered in and may not use it. The customer must follow the instructions for the returns of the damaged good as per the advise to be provided by Costa Mandorla by return email.
No right of return for the products purchased
All the goods sold by Costa Mandorla represent food and therefore no right of return for the products purchased applies.
Warranty and liability
Costa Mandorla is liable only for direct damage and loss, and only if the customer supplies proof that such damage and loss was incurred as a consequence of negligence or intent on the part of Costa Mandorla, its auxiliary persons or agents. Liability is expressly limited to the order value.
Applicable law and place of jurisdiction
Exclusively Swiss law shall be applicable to this contract.
Place of jurisdiction shall be the registered offices of Costa Mandorla, Wollerau, Switzerland.
